About these terms
These terms are an agreement between you and Nishadi Technologies Limited, a company in Nigeria (“Ganik”, “we”, “us”). They apply when you use the Ganik app, our website and our support.
You get the Ganik app from the App Store under Apple’s Licensed Application End User License Agreement (the “Apple EULA”). These terms add to the Apple EULA; they don’t replace it. If the two conflict about your license to use the app software, the Apple EULA applies.
Our Privacy Policy explains how we handle your information. By using Ganik, you agree to these terms.
Who can use Ganik
You must be at least 18 years old to use Ganik. By using it, you confirm that you are.
We intend Ganik to be available worldwide, but some features or subscriptions may not be offered in every country. This depends on the App Store and on our service providers.
What Ganik does
Ganik helps you take photos you feel good about. It includes a camera, a library of poses with step-by-step guidance, and suggestions about framing, light and posing. Some guidance is produced on your iPhone. Optional AI guidance on a photo you choose is produced using Google’s Gemini API, as described in our Privacy Policy.
AI guidance
AI guidance is creative help, not a professional service. Suggestions can be inaccurate, unsuitable or not what you expected. Use your own judgment about whether to follow them.
- Don’t treat guidance as medical, fitness, safety or other professional advice.
- Stay aware of your surroundings. Don’t pose anywhere unsafe, or in a way that could hurt you or others, for the sake of a photo.
- Guidance is generated for each request, and others may receive similar suggestions.
Your content
You own the photos you take and the content you submit to Ganik (“your content”). We don’t claim ownership of it.
When you ask for AI guidance, you give us permission to process your content, and to have our service providers process it, only as needed to give you that guidance. This permission ends when the request finishes, except for the limited copies our providers keep as described in our Privacy Policy. We don’t use your content for marketing or to train AI models.
You are responsible for your content. Only submit photos you have the right to use, and only include other people if they’re comfortable with it.
Acceptable use
When using Ganik, you agree not to:
- break the law, or infringe anyone’s privacy, likeness, copyright or other rights;
- photograph people without permission where the law or basic courtesy requires it;
- submit photos of anyone under 18 for AI guidance;
- submit sexual or sexually suggestive content, or content that harasses, threatens or demeans anyone;
- use AI guidance in ways that violate Google’s Generative AI Prohibited Use Policy;
- try to get around usage allowances, safety measures or security features;
- copy, reverse engineer, scrape or resell any part of Ganik, or access it by automated means, except as the law allows.
Ganik Pro subscriptions
Ganik offers free features and an optional paid subscription, Ganik Pro.
- What you get. The price, billing period, benefits and any usage allowances are shown in the app before you buy. Those are the terms of your subscription. Free features may also have usage allowances, as shown in the app.
- Payment. Apple charges your Apple ID account when you confirm the purchase. Prices may vary by country and may include taxes.
- Automatic renewal. Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Apple charges the renewal within the 24 hours before the period ends.
- Cancelling. You can cancel at any time in your Apple ID subscription settings. You keep Pro until the end of the period you’ve paid for. Deleting Ganik doesn’t cancel your subscription.
- Restoring. If you reinstall Ganik or change devices, use Restore Purchases in Ganik’s settings.
- Refunds. Apple handles refunds under its policies. You can request one at reportaproblem.apple.com. We can’t issue refunds directly.
- Price changes. If the price changes, Apple will tell you in advance and, where required, ask you to agree before your subscription renews at the new price.
We don’t offer a free trial unless one is shown in the app at the time of purchase.
Changes to Ganik
We’re always working on Ganik, so features may be added, changed or removed. AI guidance depends on third-party providers and may occasionally be unavailable. If a change significantly reduces what you’ve paid for during a current subscription period, contact us. Your consumer rights and Apple’s refund process still apply.
Our rights
Ganik’s app, design, pose library, guidance text and branding belong to us or our licensors. Apart from your license under the Apple EULA, these terms don’t give you any rights to them. You may use the guidance you receive to take and share your own photos.
Third-party services
Ganik relies on services from Apple, Google, RevenueCat and PostHog. Their own terms and policies apply to your use of those services, such as Apple’s terms for App Store purchases.
Suspension and termination
You can stop using Ganik at any time by deleting the app. If you have a subscription, cancel it separately in your Apple ID settings.
We may suspend or limit your access to AI guidance or other online features if you seriously or repeatedly break these terms, if your use puts others or our service at risk, or if the law requires it. Where it’s reasonable to do so, we’ll explain why.
Disclaimers
We work hard to make Ganik useful and reliable, but we can’t promise that it will always be available, error-free or give you a particular result. To the extent the law allows, Ganik is provided “as is”.
Nothing in these terms limits rights you have under consumer protection laws that can’t be waived or excluded by contract.
Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss that wasn’t reasonably foreseeable when you started using Ganik.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be limited or excluded under applicable law.
Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria have jurisdiction over disputes about them.
If you are a consumer living in another country, you keep the protection of that country’s mandatory consumer laws, and you may be able to bring a claim in your local courts.
If something goes wrong, email us first. Most problems can be resolved quickly that way.
Changes to these terms
We may update these terms as Ganik changes or the law requires. We’ll change the “last updated” date above, and if a change is material we’ll tell you in the app or on our website before it takes effect. If you keep using Ganik after a change takes effect, the updated terms apply.
